Personal Data Processing Policy

1. General provisions

This personal data processing policy is drawn up in accordance with the requirements of the Law of the Republic of Kazakhstan of May 21, 2013 No. 94-V "On Personal Data and Their Protection" and determines the procedure for processing personal data and the measures to ensure the security of personal data of the company ТОО "Акватория Актобе" (hereinafter — the Operator). Akvatoria Aktobe (hereinafter — the Operator).

1. The Operator sets as its most important goal and as a condition of carrying out its activities the observance of human and civil rights and freedoms when processing personal data, including the protection of the rights to privacy and to personal and family secrets.
2. This policy of the Operator regarding the processing of personal data (hereinafter — the Policy) applies to all information that the Operator may obtain about visitors to the website https://aqua-a.kz/.

2. Key terms used in the Policy

1. Automated processing of personal data – processing of personal data by means of computer technology;
2. Blocking of personal data – temporary suspension of the processing of personal data (except where processing is necessary to update the personal data);
3. Website – a set of graphic and information materials, as well as computer programs and databases, ensuring their availability on the Internet at the network address https://aqua-a.kz/;
4. Personal data information system — a set of personal data contained in databases together with the information technologies and technical means that ensure their processing;
5. Depersonalization of personal data — actions as a result of which it is impossible, without the use of additional information, to determine that personal data belong to a particular User or other personal data subject;
6. Processing of personal data – any action (operation) or set of actions (operations) performed with personal data with or without the use of automation tools, including collection, recording, systematization, accumulation, storage, updating (renewal, modification), retrieval, use, transfer (dissemination, provision, access), depersonalization, blocking, deletion and destruction of personal data;
7. Operator – a state body, municipal body, legal entity or natural person that, independently or jointly with other persons, organizes and (or) carries out the processing of personal data, and also determines the purposes of processing personal data, the composition of the personal data to be processed, and the actions (operations) performed with personal data;
8. Personal data – any information relating directly or indirectly to a determined or determinable User of the website https://aqua-a.kz/;
9. User – any visitor to the website https://aqua-a.kz/;
10. Provision of personal data – actions aimed at disclosing personal data to a particular person or a particular group of persons;
11. Dissemination of personal data – any actions aimed at disclosing personal data to an indefinite group of persons (transfer of personal data) or at making personal data available to an unlimited group of persons, including publishing personal data in the mass media, posting them in information and telecommunications networks or providing access to personal data by any other means;
12. Cross-border transfer of personal data – transfer of personal data to the territory of a foreign state to a foreign state authority, a foreign natural person or a foreign legal entity;
13. Destruction of personal data – any actions as a result of which personal data are destroyed irrevocably, with no possibility of further restoring the content of the personal data in the personal data information system, and (or) as a result of which the material carriers of personal data are destroyed.

3. The Operator may process the following personal data of the User

1. Surname, first name, patronymic;
2. Email address;
3. Telephone numbers;
4. The site also collects and processes depersonalized data about visitors (including "cookie" files) by means of Internet statistics services (Yandex Metrica and Google Analytics and others).
5. The data listed above are hereinafter in the text of the Policy referred to collectively as Personal data.

4. Purposes of processing personal data

1. The purpose of processing the User's personal data is to inform the User by sending emails.
2. The Operator also has the right to send the User notifications about new products and services, special offers and various events. The User may at any time opt out of receiving informational messages by sending the Operator a letter to the email address info@aqua-a.kz; marked "Opt-out of notifications about new products and services and special offers".
3. Depersonalized data of Users collected by means of Internet statistics services serve to collect information about Users' actions on the site and to improve the quality of the site and its content.

5. Legal grounds for processing personal data

1. The Operator processes the User's personal data only where they have been filled in and/or sent by the User himself through the special forms located on the website https://aqua-a.kz/. By filling in the relevant forms and/or sending his personal data to the Operator, the User expresses his consent to this Policy.
2. The Operator processes depersonalized data about the User where this is permitted in the settings of the User's browser (saving of "cookie" files and use of JavaScript technology are enabled).

6. Procedure for collecting, storing, transferring and otherwise processing personal data

The security of the personal data processed by the Operator is ensured through the implementation of the legal, organizational and technical measures necessary to comply in full with the requirements of the current legislation in the field of personal data protection.

1. The Operator ensures the safekeeping of personal data and takes all possible measures to prevent access to personal data by unauthorized persons.
2. The User's personal data will never, under any circumstances, be transferred to third parties, except in cases connected with compliance with the current legislation.
3. If inaccuracies in the personal data are identified, the User may update them himself by sending the Operator a notification to the Operator's email address info@aqua-a.kz marked "Updating of personal data".
4. The period of processing personal data is unlimited. The User may at any time withdraw his consent to the processing of personal data by sending the Operator a notification by email to the Operator's email address info@aqua-a.kz marked "Withdrawal of consent to the processing of personal data".

7. Cross-border transfer of personal data

1. Before commencing a cross-border transfer of personal data, the Operator is obliged to make sure that the foreign state to whose territory the personal data are to be transferred provides reliable protection of the rights of personal data subjects.
2. Cross-border transfer of personal data to the territory of foreign states that do not meet the above requirements may be carried out only where there is written consent of the personal data subject to the cross-border transfer of his personal data and/or for the performance of a contract to which the personal data subject is a party.

8. Final provisions

1. The User may obtain any clarification on questions of interest concerning the processing of his personal data by contacting the Operator by email at info@aqua-a.kz .
2. This document will reflect any changes to the Operator's personal data processing policy. The Policy is valid indefinitely until it is replaced by a new version.
